TERMS & CONDITIONS

1. I agree to the following as conditions of entry into the Variety Spin4Kids (Spin4Kids) Event, to be hosted at Princes Wharf No. 1. Entry fees are non-refundable. All entries are non-transferable. This means entrants cannot transfer their entry into another person's name after purchase. Fees will be processed by Funraisin website.

2. I acknowledge that: I participate in the Event at my own risk. I will take all reasonable measures to protect myself from the risks of participation. I accept all responsibility for travel and personal medical insurance and for payment and/or reimbursement of medical/surgical expenses incurred as a result of my participation in the Event.

3. All team members are over the age of 13 and at least two team members are over the age of 18. If under the age of 18, I agree to submit a specific waiver (to be emailed) signed by a parent or guardian.

4. I am responsible for all property I bring to the Event sites and acknowledge that Variety the Children’s Charity of Tasmania Tent 78 Inc. (Variety Tasmania / Variety TAS), the exclusive promoter (Variety TAS) accepts no responsibility for any loss or damage to this property.

5. I consent to the conduct of identity verification checks, background security checks and any other security checks (which may include inspecting my personal property) prior to my entry to and/or departure from any Events site.

6. I undertake to comply with all applicable regulations, by-laws and rules of the Australian Sports Anti-Doping Authority (ASADA) in relation to the Event and will comply with all reasonable directions and decisions of the officials, and other representatives of Variety the Children’s Charity staff and officials.

7. To the extent permitted by law, I release Variety TAS, Princes Wharf No. 1 & All Aerobics Fitness (and their Affiliates, directors, officers, employees, volunteers, contractors, sponsors and / or agents) from any claim and from any liability (to the extent permitted by law) for or as a result of any loss, injury or damage suffered by me in relation to my attendance and participation at the Event, however so caused, including any claim or liability which arises due to any negligence of Variety TAS, Princes Wharf No. 1 & All Aerobics Fitness (and / or their directors, officers, employees, volunteers, contractors, sponsors and / or agents).

8. I acknowledge that Variety TAS, Princes Wharf No. 1 & All Aerobics Fitness exclude all liability for any loss arising from or in connection with my participation in the Event including, without limitation, death, physical or mental harm or injury (including the aggravation, acceleration or recurrence of such an injury) and any loss or damage to my belongings or property while I am participating in the Event. Variety TAS, Princes Wharf No. 1 & All Aerobics Fitness shall have no liability in connection with: (i) any decision made or action taken by me while participating in the Event; and (ii) any indirect loss or consequential loss including, without limitation, loss of income, profits or revenue.

9. I consent to the publication and/or use in any form of media whatsoever of my name, race result, image, voice, statement or otherwise, including the publication of my name and/or event result and applicable age bracket in /or marketing materials/website without payment or compensation.

10. To the best of my knowledge, I am not suffering from a condition which would prevent and/or render me unfit to participate in the Event.

11. If the Event is cancelled for safety concerns or otherwise as a result of something beyond the reasonable control of Variety TAS, Princes Wharf No. 1 & All Aerobics Fitness including and without limitation strong winds, heavy rain, excessive atmospheric pollution, lightning and accidents, or any other Act of God, I accept that my entry fee and / or any other cost incurred in order to participate and / or get to the Event will be non-refundable. In addition I acknowledge I will have no claim against Variety TAS, Princes Wharf No. 1 & All Aerobics Fitness for any loss or damage I may suffer as a result of such cancellation.

12. Entrants are not to operate bank accounts for the purpose of fundraising using the name of Variety, Variety Tasmania, Spin4Kids or any variant thereof.

13. All money raised in the name of Variety and/or Spin4Kids is due and must be deposited with Variety Tasmania as soon as practicable after you receive the funds.

14. All funds raised in the name of Variety and/or Spin4Kids carried out by any team or individual must be passed on to Variety Tasmania in full. The fundraiser organiser is only allowed to deduct out-of-pocket expenses borne by external expenses for organising the event. This may include the cost of hiring venues, equipment, or entertainment. The organiser must not, at any time, take advantage of the public generosity and pay themselves or their associates for their time or the use of their contacts. If this proved to be the case, it may result in an instant disqualification.

15. Variety Tasmania does not provide any tax advice and makes no representations concerning the income tax deductibility or any entitlement to an input tax credit for any fees or contributions made to Variety Tasmania. The Entrant should seek and obtain his or her own independent accounting or legal advice concerning all such matters.

16. Spin4Kids entrants, their associates, supporters and sponsors must not carry out any fundraising activity which may bring Variety Tasmania and/or the Spin4Kids name into disrepute or cause Variety Tasmania to breach any statutory requirements.

17. The Variety Tasmania or Spin4Kids name or logo can only be used for fundraising activities after obtaining written consent from Variety Tasmania.

18. Privacy Declaration: Variety TAS collects uses and discloses personal information for the purposes of conducting and administrating the Event and other related activities, including for identifying participants, recording results and communicating with you.

19. I consent to event organisers using my name, image and likeness, before during or after the event, for event promotional broadcasting or reporting purposes in any media

20. As a registered entrant, you'll receive email updates about Spin4Kids. These emails include essential information that all registered participants need to be aware of for preparation and during the event.
